These Terms of Use govern the use of the “StockDisco” application (the “Service”). By registering or using the Service you agree to these Terms.
1. Scope and purpose
The Service is a purely educational and simulation environment for systematic equity strategies. It supports learning, backtesting historical strategies and simulating portfolio paths (paper trading). The Service does not execute securities orders, does not custody client assets and is not connected to any broker or custodian.
2. No licensable financial services
The operator does not provide financial services within the meaning of the German Banking Act (KWG), nor investment services within the meaning of the German Securities Institutions Act (WpIG) or Securities Trading Act (WpHG), in particular no investment advice (§ 2 (2) no. 4 WpIG), investment broking, portfolio management, proprietary trading or buying/selling of financial instruments within those laws. The Service likewise does not constitute an investment recommendation under the EU Market Abuse Regulation (MAR, Reg. (EU) 596/2014). No licence from the German Federal Financial Supervisory Authority (BaFin) is therefore required.
3. No investment advice, no recommendation
All content, tools, metrics, rankings, backtests, allocation suggestions and simulation results constitute general information and didactic examples only. They do not take into account your personal circumstances, investment objectives, financial situation or risk tolerance. They do not replace individual investment advice from a licensed adviser nor tax or legal advice.
4. User responsibility
You make all investment decisions on your own responsibility. You acknowledge that trading in equities and other financial instruments involves substantial risk up to the total loss of the capital invested. Historical price data and backtest results are not a reliable forecast of future performance.
5. Account and credentials
You are obliged to keep your credentials confidential and to protect them against unauthorised access. Please notify the operator immediately if you suspect misuse.
6. Acceptable use
Prohibited activities include in particular: automated mass scraping, reverse engineering, impairing service availability, uploading unlawful content, and using the Service to circumvent regulatory obligations or to provide licensable services to third parties.
7. Availability
The operator endeavours to provide high availability but does not owe it. Maintenance, disruptions or force majeure may lead to temporary interruptions.
8. Intellectual property
All rights in the Service, in particular software, texts, graphics and trademarks, remain with the operator or the respective rights holders. Use grants you a simple, non-transferable right of use for your own non-commercial purposes.
9. Liability
The operator is liable without limitation only for intent and gross negligence, under the Product Liability Act, and for injury to life, body or health. Otherwise liability is limited to typically foreseeable damages. Liability for investment decisions, financial losses and lost profits arising from use of the Service is — to the extent permitted by law — excluded.
10. Termination
You may delete your account at any time without giving reasons. The operator may terminate for cause, in particular for breach of these Terms.
11. Changes
The operator may amend these Terms with effect for the future. Registered users will be notified of material changes by appropriate means.
12. Governing law, venue
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the user is a merchant, a legal entity under public law or a special public-law fund, the operator’s seat is the place of jurisdiction. Mandatory consumer-protection provisions remain unaffected.
13. Severability
Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
